Business operations/Trading Terms & conditions (2)
As members will recall the Customs Brokers & Forwarders Council of Australia Inc. (CBFCA) has provided to its members appropriate Trading Terms and Conditions (refer NNF 2004/073) which business members can use as templates for their use and for any determined update / review of existing Trading Terms and Conditions.
To this end the Trading Terms and Conditions have been reviewed by the CBFCA's legal adviser Hunt & Hunt Lawyers and some minor changes have been made to the existing documents. These documents are available on the CBFCA Website under Members Documents on the password protected area of the Website.
The changes are as follows:
1. The new Trading Conditions are shown as "Year 2006 Trading Conditions" and the Authorisation and Acknowledgements (with and without AQIS conditions). For new Customers these have been amended as "Year 2006 Conditions".
2. The Deed of Guarantee is entirely new and SHOULD BE USED for all new customers.
3. The Trading Terms Conditions have been amended to include new warranties for the Customer as to Occupational Health and Safety (OH&S), Chain of Responsibility and Australian Standards compliance and obligations on the Customer to notify the customs broker at the time that it becomes aware of any problems. The indemnities have been expanded to include indemnities against OH&S and Chain of Responsibility liabilities.
The "lien" clause has also been revised so that it does not preclude any lien arising by law or statute.
4. The "notice" and "acknowledgement" for members sending out the revised Trading Conditions to existing customers has also been reworked.
As to any issue or difference between the template and members Trading Terms and Conditions, these should be noted accordingly and clarified with the member's legal adviser. As previously advised the Trading Terms and Conditions documents are provided as a member service and should be reviewed in concert with appropriate legal advice. The CBFCA accepts no liability in terms of the documents and or the manner and form for their usage
